For purposes of this Privacy Policy, we refer to our Website, products and services, and any other online service we provide that links to this Privacy Policy as the "Services." Note that this Privacy Policy does not apply to or cover External Websites (see Out of Scope External Websites section below).

Such links are not paid advertisements, nor do they constitute an endorsement by us of those External Websites. By clicking on links to the External Websites, the operators of the External Websites may collect Personal Information. We are not responsible for the content or data collection practices of those External Websites, and your use of External Websites is subject to their respective terms of use and privacy policies. As used in this Privacy Policy, "Personal Information" or "Personal Data" means any information that identifies or could be used to identify an individual person. For example, Personal Information may include name, email address, and phone number. It also includes other non-public information that we associate with such identifying information. Personal Information does not include aggregated or anonymized information.

Inferences

Inferences include opinions, trends, assumptions, and similar derivative information drawn about an individual from other Personal Information.

Precise Geolocation Data

 "Precise geolocation data," means information that can identify your vehicle’s location within approximately 1,850 feet (564 meters), or the particular radius set out under applicable privacy laws. We collect precise geolocation information only upon your consent via in-vehicle location devices when you sign up for specific Services that require it.  

Professional

Professional data includes job title, company, work address, work email, work telephone numbers, professional experiences, education, and job applications.

Profile

Profile data includes your username or similar identifier, password, and your preferences, including communications and marketing preferences.

Sensitive Information

Sensitive Information includes age, gender, racial or ethnic origin, religious beliefs, mental or physical health information, sexual orientation, family status, citizenship or immigration status, religious or philosophical beliefs, union membership, criminal convictions, or precise geolocation data.

Under the CCPA, "Sensitive Personal Information" is defined more broadly than Sensitive Information. For information on "Sensitive Personal Information," please see the Sensitive Personal Information section below.

Survey and Customer Feedback

Survey and customer feedback data includes product reviews, testimonials, or any information you provide in surveys or feedback forms about our Services.

Technical

Technical data includes your internet protocol (IP) address, login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access Services.

Telematics and Vehicle Information

Telematics and vehicle information includes odometer information and Precise Geolocation Data for your vehicle, where and as applicable.

Usage

Usage data includes information about how you use our Services such as features that you use, clickstream data, access dates and times, and how you interact with the Services, such as behavioral metrics, heatmaps, and session replay. When you visit the Website, this information may also include referring / exit pages and URLs, how you interact with links on the Website, landing pages, and pages viewed. We also may collect the date and time you open an email communication from us or click on any links in an email, and we or our service provider may associate this information with the email address we already have from you.  

  1. Sources of Personal Information

The Personal Information we collect and how we collect it depends on how you use the Services. We collect all types of Personal Information, identified above, from each of the following sources:

  • Directly from you. We collect Personal Information from you when you interact with us by filling out forms, corresponding with us, or using our Services.
  • From third-party or publicly available sources. Depending on the Services you use or how you use the Services, we collect and process Personal Information we receive from third parties and/or from publicly available sources, and we may combine Personal Information we receive from you with Personal Information we obtain from other sources. This may include third party services or subscriptions you choose to connect with our Services and partners with which we offer co-branded services or engage in joint marketing activities.
  • Third-party in-vehicle devices. Depending on the Service you sign up for, you may be required to install an in-vehicle device or system operated by a third-that may record Telematics and Vehicle Information about the use of the vehicle. The third-party is solely responsible for its use of such information and, with your consent, discloses such information to Roamly, which we use to provide you the relevant Services in accordance with this Privacy Policy.
  • Automatically. When you access or use the Services, we or our third-party agents or service providers automatically collect information about the device you use to access the Services and your activity when you use the Services.
  1. How We Use Personal Information

We only process Personal Information where there is a legal ground or lawful basis to do so and for the purposes described below. The applicable lawful basis depends on the Services you use and how you use them.  If we need to use your Personal Information for a different purpose, we will notify you and we will explain the legal basis which allows us to do so.

For European Economic Area ("EEA") and Non-United States ("Non-US") residents, please contact us if you need details about the specific legal ground we are relying on to process your Personal Information where more than one ground has been set out in the table below.

You may choose not to provide Personal Information to us. However, some Personal Information is necessary so that we can provide you with the Services you have requested. Failure to provide this information may prevent us from providing you with access to our Services.

If you are located in the EEA and other Non-US countries, please be aware that some of the third parties below may act as co-controllers in respect of your Personal Information.

  1. Third-Party Merchants

From time to time we may partner with other companies ("Merchants") to allow you to transact them directly. In order to complete these transactions, we will need to share information regarding your account with us (such as name, email address, phone number and date of birth) with the applicable Merchant so that they can meet their legal and regulatory obligations. Your information will only be shared with such Merchants to the extent you transact or interact with them.

  1. Insurance Industry Partners

To handle claims, we may disclose your Personal Information to insurers, reinsurers, insurance intermediaries, brokers, underwriters, insurance reference bureaus, medical service providers, fraud detection agencies, our advisers, loss adjusters, lawyers, accountants and others involved in the claims handling process. As permitted by law, we may also disclose Personal Information to insurance industry partners such as:

  • Third party insurance rate advisory organizations and other organizations who compile commercial databases of insurance and financial information;
  • Guaranty funds or agencies; and
  • Applicable rating agencies of the financial institution; and

  1. Third-Party Vendors

We disclose Personal Information with our third-party vendors, including consultants, agents, and contractors, that help us provide our Services or with any of the purposes described in this Privacy Policy. Depending on the Services you use and how you use the Services, the following categories of vendors may collect data on our behalf or receive Personal Information, for example:

  • Customer relationship management and customer support vendors;
  • Event co-hosts and sponsors;

We work with a third-party payment processor to collect financial and payment information for our Services. Note that your financial and payment information is passed directly to the payment processor. We will not store your credit card or have access to it after a payment is submitted. We may disclose Personal Information if we believe that it is necessary to:

Personal Information about our users will not be released to law enforcement except in response to an appropriate legal process such as a subpoena, court order, or other valid legal process that has been reviewed by us. However, if we receive information that provides us with a good faith belief that there is an exigent emergency, we may provide information to law enforcement trying to prevent or mitigate the danger, to be determined on a case-by-case basis.

We take our responsibility to protect the security and privacy of Personal Information seriously. To prevent Personal Information from being lost, used, accessed, altered, or disclosed in an unauthorized or unlawful way, we have implemented what we believe to be reasonable administrative, technical, and physical data security practices that are appropriate to the volume and nature of the Personal Information at issue.

However, no method of transmission over the Internet, or method of electronic storage, is 100% secure, and we cannot and do not guarantee that Personal Information is completely secure and safe from such risks. By using the Services, you understand and assume the risks associated with your activities on the Internet.

  1. International Data Transfers

The Personal Information that we collect or receive may be transferred to and processed in countries located outside of your country of residence to the countries where we or our third-party service providers process it. The data protection laws of the countries where Personal Information is processed may not be as comprehensive as or equivalent to those in your country of residence. Whenever we transfer Personal Information internationally, we take steps to protect it as required under applicable law.

If you are located in the EEA, the United Kingdom ("UK"), Singapore or Switzerland, we rely on the Standard Contractual Clauses to provide an adequate level of data protection for the transfer of your Personal Information from the EEA, the UK, or Switzerland, where the country of import is not deemed adequate under applicable law.

  1. Social Media Plugins

Our website may use social media plugins provided and operated by third parties, such as Facebook’s Like Button. As a result of this, you may send to the third party the information that you are viewing on a certain part of our website. If you are not logged into your account with the third party, then the third party may not know your identity. If you are logged in to your account with the third party, then the third party may be able to link information or actions about your interactions with our website to your account with them. Our Services are not intended for use by anyone younger than the age of 18 or under the applicable legal age of the relevant country. We work with third-party network advertisers, ad agencies, and other advertising partners to serve our ads online. These third-party advertising and analytics partners may collect information about your activity on our Services using tracking technologies. We may use information about you to target ads to you and to allow our third-party advertising partners (e.g., Meta/Facebook, Google, etc.) to manage our advertising on their websites. We also use third-party analytics providers to provide us with information regarding the use of the Services and the effectiveness of our advertisements. Based on the broad definitions of the terms "sale," "share," or "targeted advertising" under applicable United States state privacy laws, like the CCPA, certain data collected on or through our Services by third parties for purposes of cross-context behavioral advertising may be considered a "sale," a "share," or "targeted advertising."

In the past 12 months, we "sold" or "shared" the following categories of Personal Information or used the following categories of Personal Information for "targeted advertising":

We disclosed these categories of Personal Information to our third-party analytics and advertising partners. The business or commercial purpose of "selling" or "sharing" Personal Information or the use of Personal Information for "targeted advertising" is for our analytics and third-party advertising partners to perform specific services on our behalf, such as delivering targeted advertising and conducting analytics.

We do not knowingly "sell" or "share" Sensitive Information, including Personal Information from children under 16 years old, or use the Sensitive Information for "targeted advertising."
